This is a course concerned with the law of education, with primary emphasis on government-supported education at the primary and secondary school levels. The focus is on the institution of education as an enterprise that is highly regulated by state and federal legislatures and the courts. The course traces the evolution over the last thirty years of school law principles that affect the rights of students, teachers and others involved in the educational process. Federal constitutional and statutory rights, as well as the current law in this state and elsewhere, are considered to review the legal obligations that govern our schools.
